1. Introduction

These Terms of Service govern the hire of DJ and Karaoke services from Smithies Karaoke and DJ Hire, a division of Smithies Enterprises Group. By booking our services, you agree to comply with these terms and conditions in full.

2. Services Provided

Smithies Karaoke and DJ Hire provides professional DJ and karaoke services for various events, including but not limited to weddings, community events, parties, corporate functions, and festivals.

Specific services, inclusions, and equipment requirements will be outlined in your individual booking agreement or invoice.

3. Booking, Deposit & Payment

  • Booking: To secure your event date, a signed contract and a non-refundable deposit of $100 are required within 3 business days of booking confirmation.

  • Payment Method: Deposit and final payment must be made via bank transfer only.

  • Full Payment: The remaining balance is due 7 days before the event.

  • Late Payment: Failure to make payment by the due date may result in cancellation of your booking, and your deposit will be forfeited.

4. Cancellations and Refunds

Client Cancellations

  • More than 14 days’ notice: Your deposit may be transferred once to a new date (within 12 months), subject to availability.

  • 3–7 days’ notice: You’re eligible for a partial refund of 10% of the total booking cost.

  • No notice (day of booking): No refund is available.

DJ Cancellations
If Smithies Karaoke and DJ Hire must cancel due to illness, emergency, or unforeseen circumstances, you will receive either:

  • A full refund of any payments made (processed within 90 days), or

  • A full credit on your account to use at any time.

5. Responsibilities

Client Responsibilities:

  • Provide accurate event details, including location, access times, and contact person.

  • Ensure safe and adequate access to the setup area and power supply.

  • Maintain a secure environment for staff and equipment throughout the event.

    DJ Responsibilities:

  • Arrive on time, deliver agreed services, and behave professionally.

  • Provide quality sound and lighting using properly maintained equipment.

  • Adhere to all safety standards and workplace health obligations.

6. Safety, Weather, and Environmental Conditions

Smithies Karaoke and DJ Hire prioritises the safety and wellbeing of our staff, guests, and equipment.
We reserve the right to suspend or cease services immediately if environmental or safety conditions are deemed unsafe or unsuitable, including but not limited to:

  • Weather Conditions:
    If lightning, heavy rain, high winds, or unsafe heat levels occur, or if the event area becomes unsafe for electrical or audio equipment, our team may pause or cancel services immediately.
    Outdoor setups must be under full cover (marquee, gazebo, etc.) with safe waterproofing and grounded power supply.

  • Heat, Ventilation, and Enclosed Spaces:
    If a venue, shed, or enclosed structure lacks adequate airflow or poses a heat-related or oxygen risk to staff or equipment, services may be stopped or adjusted for safety.

  • Unsafe Behaviour or Venue Conditions:
    If guests or patrons behave aggressively, are intoxicated, or cause unsafe conditions, our staff have the right to pack down and leave immediately.

    No refund or credit will be provided in these cases, as decisions to cease services are based on safety and conditions outside of our control or caused by client negligence.

7. Equipment Responsibility and Damage

All equipment remains the sole property of Smithies Karaoke and DJ Hire, part of Smithies Enterprises Group.

  • The client is responsible for any loss, theft, or damage caused by guests, patrons, or venue staff during the event.

  • Only Smithies Karaoke and DJ Hire staff may operate or move our equipment.

  • Any damage resulting from negligence or misuse must be reimbursed in full by the client.

  • We reserve the right to shut down or remove equipment if conditions threaten safety (e.g., liquid spills, unstable surfaces, or exposed electricals).

8. Power Supply and Setup Requirements

  • A safe and reliable 240V AC power source must be available within 10 metres of the setup area.

  • All power must be properly earthed and tested.

  • The client must allow at least 60 minutes for setup and 30 minutes for pack-down unless otherwise arranged.

  • Any delay caused by insufficient setup space or unsafe power access may result in reduced performance time, with no refund.

9. Travel, Accommodation & Additional Fees

  • Travel fees apply for events outside our local Bundaberg region, unless stated otherwise in your quote.

  • For long-distance or late-night events, accommodation costs may be required.

  • Extra time or extended hours will be charged at the standard hourly rate as specified in your booking agreement.

10. Music, Requests & Content

  • Smithies Karaoke and DJ Hire reserves the right to refuse to play songs containing explicit or offensive content, particularly at community or family events.

  • Requests will be accommodated, when possible, at the DJ’s discretion.

  • All music, lighting, and sound system operation remain under the full control of our DJ at all times.

11. Photography, Video & Promotion

By booking our services, you grant Smithies Karaoke and DJ Hire permission to capture and use photos or videos from your event for marketing or promotional use, unless you request otherwise in writing prior to the event.

We will not use or publish any material that identifies minors or breaches privacy obligations.

12. Liability

Smithies Karaoke and DJ Hire will not be liable for:

  • Any injury, loss, or damage arising from event activities or venue conditions.

  • Power failure, venue restrictions, or environmental factors outside our control.

  • Indirect, incidental, or consequential damages.

Our total liability is strictly limited to the amount paid for the services.

Clients agree to indemnify and hold harmless Smithies Karaoke and DJ Hire, its staff, and representatives from any claims or damages related to the event.

13. Force Majeure

We are not responsible for any failure to perform obligations due to circumstances beyond our control, including natural disasters, acts of war, pandemics, government actions, or equipment failure caused by external conditions.

14. Governing Law

These Terms of Service are governed by the laws of Queensland, Australia. Any disputes will be resolved in Queensland courts.

15. Amendments

Smithies Karaoke and DJ Hire reserves the right to amend these terms at any time. Updated terms will be posted on our website and take effect immediately upon publication.
